Terms and Conditions

§ 1 Scope of Application

(1) These Terms and Conditions (T&Cs) are part of the contract concluded between the customer and Svež par PZ, Vojvode Dobrnjca 7, 11000 Belgrade, Serbia (hereinafter referred to as "Seller") via the Seller's online store. Any deviating terms and conditions of the customer shall not apply unless expressly accepted in writing by the Seller.

(2) Customers in the sense of these T&Cs are both consumers and businesses.

§ 2 Conclusion of Contract

(1) The contract is concluded as follows: Customers can place products in their shopping cart without obligation and correct their input at any time before submitting their binding order using the correction tools provided. By clicking the final order button, the customer submits a binding order for the items in the cart. Order confirmation is sent immediately after submission.

The Seller may accept the offer by:
- Sending a written or electronic order confirmation,
- Delivering the goods to the customer,
- Requesting payment from the customer.

The contract is concluded at the time the first of these actions occurs.

(2) The Seller saves the contract text and sends it to the customer along with the T&Cs by email.

(3) By placing an order, the customer confirms that they have read and agree to these Terms and Conditions.

§ 3 Prices, Payment, Product and Delivery

(1) Our main business activity is offering for sale sneakers from well-known brands in new condition. All products offered on our website are presented with an accurate description and price in Serbian Dinar (RSD), including statutory VAT, plus any applicable shipping costs unless free shipping is offered.

(2) Available payment methods are displayed during the checkout process.

(3) The Seller only ships within Serbia. Shipping times and costs are displayed during checkout. Unless otherwise stated, delivery typically takes 5-7 business days. We do not offer international shipping. Orders with delivery addresses outside Serbia will not be accepted.

§ 4 Right of Withdrawal for Consumers

(1) Consumers have the right to withdraw from the contract within 14 days without giving a reason.

To exercise the right of withdrawal, consumers must inform the Seller (Svež par PZ, Vojvode Dobrnjca 7, 11000 Belgrade, Serbia, E-mail: info@thefreshpair.com) by a clear declaration (e.g. letter or e-mail).

The withdrawal period is met if the notification is sent before the withdrawal period expires.

(2) Consequences of withdrawal:
If you withdraw from this contract, we will refund all payments received from you, including delivery costs (except additional costs due to a different delivery method chosen by you), within 14 days from the day we received your withdrawal notice.

We use the same payment method for refunds that you used in the original transaction, unless explicitly agreed otherwise. We may withhold the refund until we have received the goods back or you have provided proof of return.

You must return the goods without delay and no later than 14 days after notifying us of the withdrawal. You bear the direct cost of returning the goods. You are only liable for any diminished value resulting from the handling of the goods beyond what is necessary to establish their nature, characteristics, and functioning.

(3) Exclusions:
The right of withdrawal does not apply to:
- Goods that are not suitable for return for health or hygiene reasons (e.g. opened personal care products).
- Goods made to customer specifications or clearly personalized.
- Goods with elements of chance (e.g. mystery boxes, raffle-related products).

§ 5 Warranty

(1) Legal warranty rights apply.

(2) If the customer is a consumer, the limitation period for warranty claims for used goods is one year, except for damages due to gross negligence, intentional harm, injury to life, body, or health, or breach of essential contractual obligations.

(3) If the customer is a business, warranty for used goods is excluded. For other items, the limitation period is one year unless exceptions apply as mentioned above.

(4) In case of fraudulent concealment or assumption of a guarantee, statutory rights apply.

(5) Warranty is excluded for damage caused by improper use, normal wear, or changes made after receipt.

(6) The customer must describe any defect precisely and prove it existed upon delivery. The Seller may request the return of the item for inspection.

(7) Returns under warranty must be agreed upon in advance. Unfree returns will not be accepted.

§ 6 Liability

(1) The Seller is liable for damages other than injury to life, body, or health only in cases of intentional or grossly negligent conduct or breach of essential contractual obligations.

(2) This limitation does not apply to claims under the Product Liability Act or in cases of fraudulent concealment or assumption of a guarantee.

**§ 7 Retention of Title**

(1) Goods remain the property of the Seller until full payment is received.

(2) For businesses:
- Ownership remains with the Seller until all claims are settled.
- Claims from resale are assigned to the Seller.
- The customer may collect these claims unless the Seller revokes this permission.

§ 8 Cancellation of Orders

(1) The Seller reserves the right to cancel orders for any reason without prior notice.

(2) In case of cancellation, customers will be notified and any payments refunded using the original payment method.

(3) The customer has no compensation claims due to cancellation.

§ 9 Final Provisions

(1) These T&Cs are governed by Serbian law. The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.

(2) If the customer is a merchant or has no general jurisdiction in Serbia, the competent court in Belgrade shall have exclusive jurisdiction.

(3) The contract language is English or Serbian.

Opšti uslovi poslovanja

§ 1 Opseg primene

(1) Ovi opšti uslovi poslovanja (u daljem tekstu: "Uslovi") su sastavni deo ugovora zaključenog između kupca i Svež par PZ, Vojvode Dobrnjca 7, 11000 Beograd, Srbija (u daljem tekstu: "Prodavac") putem internet prodavnice Prodavca. Bilo kakvi odstupajući uslovi kupca neće biti priznati, osim ako Prodavac izričito ne pristane na njih u pisanoj formi.

(2) Kupci u smislu ovih Uslova mogu biti potrošači ili pravna lica.

§ 2 Zaključenje ugovora

(1) Ugovor se zaključuje na sledeći način: Kupac može bez obaveze dodavati proizvode u korpu i pre slanja narudžbine korigovati unose koristeći predviđene alate za ispravku. Klikom na dugme za zaključenje narudžbine, kupac daje obavezujuću ponudu za kupovinu artikala u korpi. Potvrda prijema narudžbine se automatski šalje nakon slanja.

Prodavac može prihvatiti ponudu:
- slanjem pisane ili elektronske potvrde narudžbine,
- isporukom robe kupcu,
- zahtevom za uplatu od strane kupca.

Ugovor se smatra zaključenim u trenutku kada se prva od navedenih radnji izvrši.

(2) Prodavac čuva tekst ugovora i šalje ga kupcu zajedno sa ovim Uslovima putem e-pošte.

(3) Slanjem porudžbine kupac potvrđuje da je pročitao i da se slaže sa ovim Opštim uslovima kupovine.

§ 3 Cene, plaćanje i isporuka

(1) Naša glavna delatnost je preprodaja patika poznatih brendova u novom stanju. Svi proizvodi ponuđeni na našem veb-sajtu predstavljeni su sa tačnim opisom i cenom u dinarima (RSD), uključujući zakonski PDV, uz dodatne troškove isporuke ako nisu drugačije navedeni.

(2) Dostupni načini plaćanja prikazani su tokom procesa narudžbine.

(3) Isporuka se vrši isključivo na teritoriji Republike Srbije. Vreme isporuke i troškovi prikazani su tokom procesa poručivanja. Ako nije drugačije navedeno, dostava se realizuje u roku od 5 do 7 radnih dana. Ne vršimo isporuku u inostranstvo. Porudžbine sa adresama isporuke van Srbije neće biti prihvaćene.

§ 4 Pravo na odustanak za potrošače

(1) Potrošači imaju pravo da odustanu od ugovora u roku od 14 dana bez navođenja razloga.

Da bi ostvarili pravo na odustanak, potrošači moraju obavestiti Prodavca (Svež par PZ, Vojvode Dobrnjca 7, 11000 Beograd, Srbija, E-mail: info@thefreshpair.com) jasnom izjavom (npr. pismom ili e-mailom).

Rok za odustanak se poštuje ako je obaveštenje poslato pre isteka roka.

(2) Posledice odustanka:
Ako odustanete od ovog ugovora, vratićemo vam sve uplate koje smo primili od vas, uključujući i troškove isporuke (osim dodatnih troškova ako ste izabrali drugi način isporuke), u roku od 14 dana od dana kada smo primili obaveštenje o odustanku.

Povraćaj će biti izvršen istim načinom plaćanja koji je korišćen prilikom originalne transakcije, osim ako nije drugačije dogovoreno. Povraćaj možemo zadržati dok ne primimo robu nazad ili dok ne dostavite dokaz da ste je poslali.

Roba se mora vratiti bez odlaganja, najkasnije 14 dana od dana slanja obaveštenja o odustanku. Troškove vraćanja robe snosi kupac. Kupac odgovara za umanjenje vrednosti koje je posledica rukovanja robom izvan onog što je nužno za utvrđivanje prirode, svojstava i funkcionalnosti robe.

(3) Izuzeci:
Pravo na odustanak se ne odnosi na:
- robu koja iz zdravstvenih ili higijenskih razloga nije pogodna za vraćanje (npr. otvoreni proizvodi za ličnu negu),
- robu izrađenu po specifikaciji kupca ili jasno personalizovanu,
- robu sa elementima iznenađenja (npr. "mystery box", proizvodi povezani sa nagradnim igrama).

§ 5 Garancija

(1) Primjenjuju se zakonska prava potrošača.

(2) Ako je kupac potrošač, rok za reklamaciju korišćene robe je godinu dana, osim u slučajevima grube nepažnje, namerne štete, povrede života, tela ili zdravlja, ili povrede osnovnih ugovornih obaveza.

(3) Ako je kupac pravno lice, reklamacija za korišćenu robu je isključena. Za drugu robu, rok za reklamaciju je godinu dana, osim u izuzetnim slučajevima navedenim gore.

(4) U slučaju obmane ili garancije, primenjuju se zakonska prava.

(5) Garancija se ne odnosi na štete nastale nepravilnim korišćenjem, uobičajenim trošenjem ili izmenama nakon prijema.

(6) Kupac mora precizno opisati kvar i dokazati da je postojao pri isporuci. Prodavac može zatražiti povrat robe radi provere.

(7) Povraćaj robe po osnovu garancije mora biti unapred dogovoren. Roba vraćena pouzećem neće biti prihvaćena.

§ 6 Odgovornost

(1) Prodavac odgovara za štetu van povrede života, tela ili zdravlja samo u slučaju namere ili grube nepažnje, ili povrede osnovnih ugovornih obaveza.

(2) Ovo ograničenje ne važi za odgovornost prema Zakonu o odgovornosti za proizvod, u slučaju obmane ili garancije.

§ 7 Zadržavanje vlasništva

(1) Roba ostaje vlasništvo Prodavca dok se ne izvrši puna uplata.

(2) Za pravna lica:
- Vlasništvo ostaje kod Prodavca dok se ne izmiruju sve obaveze.
- Potraživanja iz preprodaje se prenose na Prodavca.
- Kupac može naplatiti potraživanja osim ako Prodavac ne opozove ovu dozvolu.

§ 8 Otkazivanje narudžbina

(1) Prodavac zadržava pravo da iz bilo kog razloga otkaže narudžbinu bez prethodne najave.

(2) U slučaju otkazivanja, kupac će biti obavešten, a uplata vraćena putem istog načina plaćanja.

(3) Kupac nema pravo na naknadu štete zbog otkazivanja.

§ 9 Zavrsne odredbe

(1) Na ove Uslove primenjuje se pravo Republike Srbije. CISG (Bećka konvencija) se ne primenjuje.

(2) Ako je kupac pravno lice ili nema prebivalište u Srbiji, nadležan je sud u Beogradu.

(3) Jezik ugovora je srpski i engleski.
